TERMS AND CONDITIONS:

1. This registration form (“Form”) and the terms and conditions (“T&C”) contained herein are binding
   on you, the participant (“Participant”) in the participation of the The Malaysia Invasion Mixed Martial Arts (“MIMMA”)
   competition : Grand Finals Match (“Event”), organized by Tune Talk Sdn Bhd (hereinafter referred to as “Promoter”).
2. By entering into this Event and completing the Form, you hereby consent and agree to the terms and conditions
   (“T&C”). You warrant and represent that:
   1. as of the date of the Event, you are eighteen (18) years of age and/or above; and
   2. all of the personal information provided by you to us is true, correct and complete; and
   3. that you have read, understood and accepted all the terms and conditions contained in this document, and
      that they are binding on you.
3. The Participant will not be allowed to claim for any damages, costs, losses, liabilities, reponsibilities and/or claims which
   may occur as a result of the Participant’s participation in this Event. The Promoter is not responsible nor liable for the
   safety or condition of the Participant or for any injuries sustained by the Participant prior, during or after the Event.
4. The Participant shall be solely liable for any untruthful information provided in this Form or at any occasion in relation
   to this Event The Participant must read the Form in its entirety before signing. The Participant must also verify and
   confirm all statements by placing his initials at each numbered item as well as signing the Participant’s full name below.
   The Promoter and /or sponsors have no responsibility to verify the accuracy of the Participant’s information.
5. Non-Competition: The Participant wholly agrees and undertakes that he will participate exclusively for the Promoter
   and/or events related to MIMMA for the entire duration of his involvement as a participant/fighter in this tournament
   and will not take active participation as a fighter/contender/participant and/or contestant in any other mixed martial
   arts and martial art(s) competition, match and/or tournament wherever it may be held without the written consent
   of the Promoter. In event of such default(s), the Participant wholly agrees and accepts that the Participant will be
   penalised and has to refund back and/or forfeit immediately to the Promoter: any allowance, compensation, award,
   and/or reward of any kind and type which the Participant received or due to receive from the Promoter for the
   Participant’s involvement in the tournament. The Participant shall further be liable to pay compensation to the
   Promoter for any losses sustained and costs which is accrued due to such default(s).
6. In furtherance to Clause E, the Participant hereby undertakes not to be identified with, or be related to, in any manner
   with parties which is competing with the business of the Promoter, in the sports of mixed martial arts (MMA) )directly
   or indirectly, for one (1) year immediately preceding the conclusion of the Participant’s involvement in MIMMA without
   the Promoter’s prior written consent. The definition of “competing” is up to the sole definition and interpretation of
   the Promoter.
7. Except as noted herein, this Agreement shall constitute the entire agreement between the Promoter and the
   Participant with respect to the Participant’s involvement in the sports of mixed martial arts (MMA) and shall supercede
   all agreements with respect thereto, whether prior or antecedent to this Agreement herein.

1. DEFINITION

To simplfy this document for you the following terms will apply:

• AMATEUR: One who engages in an activity as a pastime rather than as a professional; one who lacks expertise.
• AMATEUR IN SPORTS: An athlete who has never participated in competition for more than RM500.00. An athlete
  who is not paid for his performance. An athlete who is at the beginning learning levels of his career.
• PROFESSIONAL: Performed by persons receiving pay. An expert in a field of endeavor.
• PROFESSIONAL IN SPORTS: athlete who is paid more than RM500.00 for his performance. Paid for their excellence of
  experience, knowledge and ability of their given sport. An athlete who gets paid to participate in sporting events.
• YOU or PARTICIPANT: the individual who has participated and signed up for the Event in accordance with the terms
  and conditions herein

2. ENTERING THE EVENT

1. The Participant hereby declares that he has read the Form in full and fully understands the meaning and importance of its
   contents. The Participant acknowledges that the terms and conditions herein are binding on him towards participation of the
   Event.
2. The undersigned Participant, acknowledges and confirms that he has accepted and will abide by all terms stated herein in
   connection with his participation to compete in the Event as an AMATEUR Mixed Martial Artist (“AMATEUR”)
3. The Participant further declares and represent that he is at least eighteen (18) years of age, that he has full legal capacity to enter
   into this Event and to be bound by the terms and conditions herein, and that he is signing this Form of his own free will and
   accord.
4. In the event the Participant is not a subscriber of Tune Talk Sdn Bhd’s mobile telephony service (the “Service”), the Participant
   agrees to and shall subscribe to become a prepaid subscriber of Tune Talk Sdn Bhd’s Service prior to registering for the Event.
5. The Participant confirms that as at the date of the Event, that;
   • He has Never been contracted or fought as a professional Kickboxer, Muaythai Fighter, Mixed Martial Artist or Professional
     Boxer in the past.
   • He has Never been contracted or fought as a Professional in ANY Full Contact Fight Sport in the past.
6. A person with coronory disease, epilepsy, a severe medical problem or who is under the influence of alcohol or drugs or under
   any form of medication on a regular basis, should not participate in this Event without prior written approval of their doctor.
   The onus is on the Participant to ensure he is medically fit to participate in the Event and the Promoter shall not be responsible
   to verify the physical (or emotional) condition of the Participant and shall not be accountable for any injuries arising to the
   Participant due to the Participant’s failure to ensure he is medically fit and sound to participate or compete in the Event.
7. The Participant shall follow the instructions and advise of the Promoter, sponsors and or any other party involved in the
   operation of the Event, especially with regards to safety gear, equipment and/or sparring techniques. The Promoter shall not be
   responsible or liable for any injuries caused to the Participant during or after the Event.
8. The Promoter reserves the right to withdraw, suspend or disqualify the Participant at any time during the Event (without the
   need to asign any reason) and the decision of the Promoter shall be final.
9. The Promoter shall also be entitled to disqualify the Participant in the event of misconduct, misbehaviour, unnecessary violence,
   misrepresenation on part of the Participant, and such decision of the Promoter shall be final and binding.
10. The Participant shall not be entitled to a claim for damages or remedies against the Promoter for any suspension, withdrawal or
    disqualification of the Participant from the Event.

3. PRO FIGHTERS FIGHTING AS AN AMATEUR

1. The Participant fully understands and agrees that if he has not been truthful with any of the information given and provided
   to the Promoter herein or at any time during the Event, the Participant shall immediately be disqualified from the Event by the
   Promoter.
2. Notwithstanding the above, the Promoter reserves the right to disqualify the Participant at any time during the Event wihtout
   having to provide a reason for the same.
3. Any decision with regards the disqualification of the Participant shall be subject to the sole and absolute discretion of the
   Promoter and such decision shall be final.

5. USE OF THE PARTICIPANT’S NAME, IMAGE, PHOTO, LIKENESS, SOUND, SIGNATURE AND ANY VISUALS CONTAINING THE
PARTICIPANT

1. The Participant hereby grants his permission and will not be claiming any money/payment/royalties or take action
   against the Promoter, television station or any party that records and broadcasts the visuals or any other visuals that
   relates to the Participant before, during and after the Event, including the promotional reels for this and future events.
2. The Participant hereby grants to the Promoter the right to use the Participant’s name, visuals, image (both moving
   and still), likeness, sound, signature, sobriquet, autograph photograph, portrait, caricature, silhouette and voice
   (collectively known as “Participant’s Likeness”), the audio or visual recordings of the Participant in the Event for the
   purposes of running commercials and advertisements, broadcast in any media including but not limited to, satellite,
   cable television, Internet, mobile, radio, print and other channels; and collateral branding materials, which include
   billboards and buntings amongst others, designed to support the Promoter’s marketing and promotional materials.

6. DISCLAIMER AND WAIVER OF RIGHTS

1. The Participant recognizes that there are risks of injury that may arise and are common to any performing arts
   programme such as in the Event. The Participant hereby waives and releases the Promoter from and against any and all
   claims which shall include but are not limited to any type of direct or indirect injury (whether emotionally, physically or
   otherwise), casualty, death, punitive, special, consequential damages or loss, howsoever arising due to the Participant
   preparation for the said Event including during and/or after participating in the Event.

7. INDEMNITY

Participant agrees to indemnify the Promoter against any damages, actions, proceedings, claims, losses, costs and
expenses (including legal fees) that the Promoter may suffer as a result of the Promoter’s non-adherence or breach of the
representations, covenants, warranties and terms and conditions contained in this document.

8. FUTURE EVENTS

Participant agrees to attend any future events conducted by the Promoter in relation to MIMMA. The Promoter may give the
Participant a token of appreciation and / or payment in kind to the Participant in attending the said future events.

9. BINDING DOCUMENT

This document is the contract between you, the Participant and the Promoter, and shall be legally binding in accordance with
the applicable laws, and interpreted and construed in accordance with the terms and conditions set by the Promoter.

I hereby accept and agree to the Terms & Conditions contained in this Form and shall be bound by the same. I further confirm that I am at least eighteen (18) years old and that the information I have provided herein is true, correct and complete. Further, I understand that any misrepresentation of information or misconduct on my part will result in my disqualification from the Event.
